The Controller provides online coaching services to clients located in any U.S. state or territory (“U.S. Clients”).

2. Purposes of Processing:

  • Provide, schedule, and bill for online coaching services.

  • Fulfil legal obligations (tax, accounting, consumer protection, record‑keeping).

  • Establish, exercise, or defend legal claims.

  • Comply with relevant U.S. federal and state privacy / consumer‑protection laws.

3.  Notice at Collection – Categories, Purpose & Retention

  • Identifiers (name, e‑mail, phone): communication and client account - retained 7 years after service completion.

  • Session content/wellbeing notes (non‑clinical): personalisation of coaching - retained 7 years after service completion.

  • Payment records: billing and taxes - retained 5 years from the end of the tax year.

4.  No Sale/Share - Personal data is not sold or shared for cross‑context behavioural advertising as defined by CPRA and other state laws.

5.  Your Privacy Choices - voluntarily extended rights (U.S. state privacy laws):

  • Access a copy of your data.

  • Correct inaccurate data.

  • Request deletion except where retention is legally required.

  • Receive data in a portable format.

  • If it goes to the U.S. and the recipient is on the EU–US Data Privacy Framework (DPF) list, we rely on that adequacy decision.

  • If not, we use the 2021 Standard Contractual Clauses (SCC) plus extra safeguards like end-to-end encryption and strict access controls.

  • Any copies sent back from the U.S. to the EU are protected in the same way

8.  Automated Processing - No automated decision‑making or profiling that produces legal or similarly significant effects.

9. Consumer‑Protection Information (online coaching for U.S. clients)

  • Transparent pricing: full session price and any fees are disclosed in USD before you book.

  • Right to cancel/reschedule: You may cancel without fee up to 24 hours before a session; late cancellations may incur the full session fee (except for genuine emergencies).

  • Professional competence: sessions will be delivered with reasonable care and skill following generally accepted coaching standards.

  • Complaint pathway: raise concerns directly with the Coach (response within 14 days); if unresolved, you may pursue mediation / small‑claims remedies permitted in your state.

  • Governing law & venue: this agreement is governed by U.S. federal law and the laws of your state of residence, with non‑exclusive jurisdiction in U.S. or Polish courts (your choice).
